Well in this case I agree that the possible timing issue, is not the 
problem. It is probably the OpenSSL version that is the problem. I 
discovered yesterday that we got this error with the OpenSSL version 
1.0.1l. Only this test case runs with only defaults to s_client and all 
other configured test cases run well. Using a non RSA cipher suite 
seemed to fix the problem.
